1. Estimates and Quotes

  • Validity: All written estimates and quotes provided by Sumastar Enterprises Ltd are valid for a period of thirty (30) days from the date of issue, unless otherwise stated.
  • Variations: Estimates are based on a visual inspection or details provided by the client. If hidden structural issues, hazardous materials, or necessary system upgrades are discovered during installation or repair, a revised quote will be provided before further work commences.

2. Payment Terms

  • Deposits: For major installations, cold room builds, or commercial system replacements, a non-refundable deposit (typically 50%, or as outlined in your specific contract) is required prior to the ordering of equipment and scheduling of work.
  • Final Payment: The remaining balance is due immediately upon the completion of the project and the commissioning of the system, unless prior corporate credit terms have been established.
  • Late Payments: Overdue accounts may be subject to late fees or the suspension of ongoing maintenance contracts.

3. Services and Site Access

The client agrees to provide our technicians with safe, unobstructed access to the work area, including necessary electrical panels, roofs, and ductwork. Sumastar Enterprises Ltd is not liable for project delays caused by a lack of site access or delays by other third-party contractors on site.

4. Warranties

  • Equipment Warranty: All new air conditioning units, chillers, cold room panels, and parts are covered by their respective manufacturer’s warranty. Sumastar Enterprises Ltd will assist in processing warranty claims, but we are not the manufacturer of the equipment.
  • Labor Warranty: We guarantee the quality of our workmanship. Sumastar Enterprises Ltd provides a standard labor warranty on all new installations (duration specified in your individual contract).
  • Voiding Warranty: Warranties are strictly voided if the equipment is tampered with, repaired by an unauthorized third-party technician, or damaged due to abnormal electrical power surges or “dirty power” outside of our control.

5. Limitation of Liability

While we take every precaution to protect your property, Sumastar Enterprises Ltd shall not be held liable for any incidental, consequential, or indirect damages arising from the failure of HVAC or refrigeration equipment, including but not limited to the loss of perishable goods, business interruption, or property damage caused by water leaks or pre-existing structural flaws.

6. Cancellations

Service appointments must be canceled at least 24 hours in advance. For large installation projects, cancellations made after equipment has been ordered or custom-fabricated may be subject to restocking fees and the forfeiture of the initial deposit to cover incurred costs.

7. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising out of these terms or our services shall be resolved within the jurisdiction of the Kenyan courts.
